Services Offered

The Park or Charge platform provides a means for property owners and end-users to reserve and pay for parking spaces and electric vehicle (EV) charging services. The platform is intended solely as a payment and reservation facilitator. It does not include the installation, maintenance, or warranty of EV chargers or parking infrastructure. Park or Charge does not warrant the functionality, condition, or availability of any parking spaces or EV chargers.

Property Owner Responsibilities

a. Property owners must ensure that their parking spaces and EV chargers comply with all applicable local, state, and federal laws, including zoning, building, and safety regulations.

b. Any required permits, inspections, or certifications are the sole responsibility of the property owner.

c. Property owners must maintain their parking spaces and EV chargers in a safe and operational condition.

d. Property owners are responsible for handling all financial and tax-related obligations arising from the use of their properties through the Park or Charge platform.

User Responsibilities

a. End-users must be of legal age and have the authority to enter into agreements to use the platform.

b. End-users are responsible for providing accurate and up-to-date information during the reservation and payment process.

c. End-users must keep access credentials confidential and not share them with unauthorized individuals.

d. End-users are solely responsible for any charges, fines, or penalties incurred during their use of parking spaces or charging services.

e. Any disputes regarding parking availability, EV charger functionality, or other property-specific issues must be resolved directly between the end-user and the property owner.

Reservation and Payment

a. Reservations are subject to availability and may require payment in advance.

b. All payments must be made using the accepted methods specified on the platform.

c. Once a reservation is confirmed and payment is received, any cancellation or refund policies will apply as stated on the platform.

d. Park or Charge does not guarantee uninterrupted access to the platform or error-free processing of reservations and payments. No warranties are provided regarding uptime or app functionality.

Indemnification and Hold Harmless

a. Property owners agree to indemnify, defend, and hold harmless Park or Charge, its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses arising from the use of their parking spaces, EV chargers, or any related incidents.

b. End-users agree to indemnify, defend, and hold harmless Park or Charge, its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses related to their use of the platform, including but not limited to accidents, property theft, and unauthorized use of the platform.

Limitation of Liability

a. Park or Charge shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the platform. This includes, but is not limited to, damages resulting from accidents in parking lots, stolen property, malfunctioning EV chargers, fraudulent transactions, or interruptions in service.

b. Park or Charge is not responsible for verifying the accuracy, availability, or suitability of any parking spaces or EV chargers listed on the platform.

Privacy Policy

Park or Charge is committed to protecting user privacy and handling personal information in accordance with applicable laws and regulations. Please refer to our Privacy Policy for more information.

Termination

Park or Charge reserves the right to suspend, terminate, or restrict access to the platform at any time without notice, for any reason, including but not limited to violations of these terms and conditions.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Los Angeles County, California. Any disputes arising out of or relating to these terms and conditions shall be resolved in the courts of California.
